The death of a model who learnt that her husband was already married has shone a light into the murky world of Muslim polygamy in Britain.
Sahar Daftary, 23, fell 150ft from the twelfth storey of a block of flats where she had gone to collect her belongings at the home of a businessman whom she had married in a religious ceremony last year.
Her husband, Rashid Jamil, 33, was arrested on suspicion of murder but bailed by police after they found no evidence that the death was anything other than an accident or suicide.
Ghayasuddin Siddiqui, the head of the Muslim Parliament of Great Britain, told The Times: “This story is very common, unfortunately. We have tried to plug some of the holes in the whole system, but unfortunately our clerics do not live on this planet.
“They don’t understand. For them, controlling the sexuality of the woman is far more important than justice, so we have this problem.”
Ms Daftary, a Sunni Muslim from London whose family comes from Afghanistan, was crowned Miss Face of Asia in a beauty contest last year. She was found critically injured by the apartment block in Salford Quays near the Manchester United football ground on Saturday. She had been helping with make-up at a fashion show in the city but left early to collect clothes from Mr Jamil’s home.
Ms Daftary also wanted to arrange an Islamic divorce from him. She had undergone a Muslim wedding ceremony in Brentford, West London, only to learn later that her husband already had a wife.
Her sister, Mariya Massumi, a hairdresser, said: “A few months after they got married we had a phone call from Narissa Amjad, and she said she was Rashid’s wife. We were very shocked and we confronted him.” Relatives learnt that Ms Amjad, 29, a marketing executive, was expecting a second child by Mr Jamil.
Islam traditionally allows husbands to take up to four wives at a time. A confrontation took place at Mr Jamil’s detached house in Altrincham, Manchester, where Ms Amjad lived.
Ms Massumi said: “When we arrived he was very calm. He said to Sahar he was not happy with his wife. He said in front of his wife he wanted to live with Sahar. His wife Narissa was also very calm and said that was OK. We were all so shocked. Rashid told Sahar he loved her.”
Mr Jamil also had a former wife, Sebina Malik, a lawyer. They had a daughter but were formally divorced. According to relatives, Mr Jamil had also undergone an arranged marriage in Pakistan that ended in divorce.
Dr Siddiqui said some British Muslim clerics performed polygamous marriages. The ceremonies are unrecog-nised by law. Clerics let husbands end marriages by saying “I divorce you” three times. Ex-wives have no rights.
Ahmad Thomson, a barrister and founder of the Association of Muslim Lawyers, said that polygamous marriages could work in Britain if all parties were open and in agreement. But he added: “Sometimes the husband has tried to keep the earlier marriage secret. When the second or third wife finds out, it’s devastating.” dkennedy@thetimes.co.uk

I am a muslim women and I have lived in the UK all my life. I have seen how some muslim men twist the rules of Islam to suit their own needs. What has happened to this young woman is horrifying. I honestly believe in what goes around comes around. I do believe that as a woman I have more rights in this country than the country of my origin.
I know that in the country of my origin I have not had any rights at all. In fact if I had a husband who was to marry again without my knowledge in that country and if I was to find out about it, it would be difficult for me to obtain a divorce ( this would be due to the double standard nature of that society). I believe that in order to stop this kind of thing happening again, these muslim men ( and I mean the ones who take advantage of these situations because not all of them are like this) should be told that we will not put up with this anymore. The country of my origin is a muslim country, however it is not Islam that takes the right of women away from them, but the corrupt and double- standard nature of men.
I have experienced women accepting their husbands taking on another wife in this country, even when their husbands do not abide by the polygomous marriage rules which authoriese a man to marry again. In my times of need and unhappiness and times when I have wished to take a stance against my relative only one thing has helped me and that is Islam.
If my husband was to come home and say to me I have married again, then I would file for divorce straight away and I know that Islam allows me to do this. The problem is that Islam and the culture of my country are two different things.

Men in Islam WERE allowed to marry more than once with the previous wife's consent at a time when women were left as widows after the Jihad battles during the Prophet PBUH time. Men should stop using that as an excuse to exploit women and educated women should know better than to be controlled.

Women do have rights in Islam. Sûrah Al-Baqarâh. When a husband acts irresponsibly toward his wife, she is permitted to take matters into her own hands and file for divorce. The wife's right to ask for divorce does not have any time limit.

Rashid Jamil cannot be prosecuted for bigamy because the marriage was not legal under British law. As far as I'm aware, the Muslim Parliament of Great Britain operates in much the same way as the General Synod ( the parliament for the Church of England).

Catholics have a "church" court to deal with canon law. However, rulings here are binding only within the church itself - they are not binding in the secular world. Perhaps this is an option for Muslims?

The UN Convention on the Elimination of All Forms of Discrimination Against Women states polygamy discriminates against women, reduces them to concubinage, denies them any right to their "husband's" estate, and impoverishes them and their children. For these reasons it should be banned.

Under British law it is only ILLEGAL to have 2 CIVIL marriages without divorce annuling one of them. The fact that the British law does not recognise the Islamic Nikah (marriage) as legally binding makes it LEGAL to have more than one wife, as it is exactly the same as being a common law wife!

Bigamy is rarely punished by law in the UK, unless fraud and deception for monetary gain is also invoilved. The decision is entirely at the discretion of the D of PP.
Nonetheless contempt of Court is always available, and is , I suggest, appropriate if "Custom & Pratice" is pleaded by Muslims.

Immigrants should comply with the laws of a land. That is globally historical, and functional. If someone disagrees with a country's law, they ought to not to move to that land. That's freedom: freedom to live where you agree with the laws. If you don't like a country's law, stay in your country.

The issue here is the legal protection women are entitled to under the law. Muslim women deserve the full protection of English law when they live in this country, are citizens of this country, or are married in this country. But polygamy is illegal and no exceptions should be allowed.

Islamic "marriage" ceremonies in Britain do not normally include a legal registration of the marriage. It follows that the couple are not actually married at all, and therefore the arrangement cannot be bigamous. Nor has the woman much protection if they split up. That's their choice.

The bottom line is that polygamy is illegal here. These women are legally unprotected so it must be against their human rights. The Muslim Institute's marriage contract will merely make the practice appear legal. All that is needed is government will to stop clerics performing these marriages.
